Kuala Lumpur officials have no business putting Suluks on trial under Kuala Lumpur justice system

Moreover, Kuala Lumpur has no business labelling them 'terrorists' because they are not. We must all remember that the Royal Sulu Army and their supporters went to Sabah which, by Philippine law, is Philippine territory. 

Under Republic Act 5446, the Philippines has title and dominion over Sabah. The Philippine Government and its leaders must not allow Kuala Lumpur to further inflict and heap abuse on Suluks and Filipino Tausugs.  

The Philippine Government and Filipinos worldwide must vigorously protest Kuala Lumpur's planned farce against Suluks in Sabah that they call justice system. Do not trust Malaysians! Their justice system is highly flawed and  is meant more to amuse the Malaysian gallery than to deliver justice.

A very good example: Just ask former Malaysia Deputy Prime Minister Anwar Ibrahim (in picture) about how Kuala Lumpur's rocambolesque justice system dealt with his case when he dared opposed Mahathir! Human Rights Watch said Malaysia proceedings against Mahathir violated basic fair trial rights.

Our Suluks have absolutely no chance of getting a fair trial in the hands of the illegal occupants of Sabah as we shout loud and clear to the world that Kuala Lumpur has no business putting them on trial!

Court will try intrusion case fairly says Malaysia's Attorney General Gani from Kuala Lumpur  

KUALA LUMPUR: Attorney-General Tan Sri Abdul Gani Patail is confident Malaysia’s courts will try the Sulu terrorists involved in the intrusion into Lahad Datu, Sabah in a fair and efficient manner. 
He said the case would not take too much time to complete. 
“Ever since Tun Zaki (former Chief Justice Tun Zaki Azmi) started the programme in court, I think they have been very efficient. 
“Mention date has been set on April 12, and then we will fix for trial, insya-Allah, I think within months we will have the trial. 
“But, we must also take into account the security circumstances, as the matter is not something straight-forward,” he told reporters after witnessing the signing of a renewal of agreement between the Malaysian Government and the Asian-African Legal Consultative Organisation (AALCO) here Tuesday. 
Abdul Gani said the case investigation officer would meet him Wednesday, to give a briefing on the terrorists who were still under detention.

The 'fearmonger strategy' of the Aquino administration on the Republic's Sabah claim

Admin Anne of the Philippine Sabah Claim Forum said in one of her comments yesterday that it was rather sad that some quarters in the Philippines close to the President have been fear mongering - dutifully following the fearmonger strategy adopted by President Aquino, and actively raising the spectre of war, instilling in the hearts of people the fear that if the President so much as raises the Philippine Sabah territorial claim to Sabah with Prime Minister Najib, the Philippines will find itself at war with Malaysia. 

The advisers to President Aquino are wrong. Their logic devoid of real merit. The President should give Prime Minister Najib the opportunity to present his reply. The President must not allow this instinctive but unjustified fear of war with Malaysia to be the guiding force and instrument of this nation's foreign policy.

Fifty-one years ago, Senator Salonga exhorted Filipinos and their leaders not to cede in to unjustified fear. Fifty-one years later, we still find the same fear mongerers in the upper echelons of Philippine Society. The end result is death and destructions to the lives of the Tausugs in Sabah these last fifty one years and deaths to the Sulu fighters in Sabah today.

It is rather pathetic that after all these years, we still have not found the courage to raise the Philippine Sabah claim and persuade Malaysia to sit down with us to discuss this very important issue.

We ask the Government of Pesident Aquino to to adopt the courageous tack today in order to prevent more Filipino Tausug blood spilling in the hands of Malaysian military in Sabah.

On a side note, I find it rather uncanny that Senator Salonga's introduction to the presentation of facts about the Philippine claim to North Borneo (Sabah) which he published in May 1962, is still very much relevant today: 

"At the other end of the line are the faint-hearted souls who cherish a host of vague, nameless fears, and who have not stopped imagining the catastrophic, nuclear wars into which the Philippines would be drawn should it so much as attempt to press the claim to North Borneo, regardless of the merit or validity of such a claim. Responsible quarters confess to no little measure of amusement over the unrestrained enthusiasm, on the one hand, of home-grown nationalists in supporting claims — without adequate study of their validity — of sister countries in Asia over territories held by Western powers, and their unconcealed dread, on the other hand, in espousing a claim — without the slightest inquiry into its possible merit — over a portion of the globe's surface which may belong as a matter of law and equity to Filipinos."

OUR QUESTIONS: What is President Aquino doing to protect the thousands and thousands of "stateless" Filipinos in Sabah who were born in the land which, by Philippine law, is Philippine territory. Will President Aquino continue to support the inhuman and illegal treatment being inflicted by Kuala Lumpur officials on Filipino Suluks and other Filipinos of various ethnic origins in Sabah? When will President Aquino be a patriot?

What will it take for this Republic to stand up for what is right? Where are its leaders?

If this government condones what the officials of Kuala Lumpur are doing, there is no chance for other countries, not even the United Nations, to help the citizens of the Republic in peril in Sabah.

Bates Treaty of 1899 with Sultan of Jolo is classic example of US decepttion

The Bates Treaty of 1899 was a classic example of American deception and use of treaties in deceptive ways. If the intent of colonization of the Philippines was “by God’s grace to do the very best by them” as indicated by President McKinley, the Bates Treaty was an unusual way to achieve this. The Treaty grants some degree of autonomy and protection to the Sulu Sultanate which effectively kept them out of the Philippines-American War.
However, once the war ended, the terms of the Bates Treaty were broken and the United States moved to bring the Moro territories under American military control. These actions lead to the Moro War.

Conditional Agreement Between Brig. General John C. Bates, Representing the United States, and the Sultan of Jolo (Sulu), August 20, 1899
Between Brigadier-General John C. Bates, representing the United States, of the one part; and his Highness, the Sultan of Jolo, the Dato Rajah Muda, the Dato Attik, The Dato Calbi, and the Dato Joakanain, of the other part: it being understood that this agreement will be in full force only when approved by the Governor-General of the Philippine Islands and confirmed by the President of the United States, and will be subject to future modifications by the mutual consent of the parties in interest. 
Article I. The sovereignty of the United States over the whole Archipelago of Jolo, and its dependencies, is declared and acknowledged. 
Article II. The United States flag will be used in the Archipelago of Jolo, and its dependencies, on land and sea. 
Article III. The rights and dignities of His Highness the Sultan, and his Datos, shall be fully respected; the Moros are not to be interfered with on account of their religion; all religious customs are to be respected, and no one is to be persecuted on account of his religion. 
Article IV. While the United States government may occupy and control such points in the Archipelago of Jolo as the public interests demand, encroachment will not be made upon the lands immediately about the residence of His Highness the Sultan, unless military necessity requires such occupation in case of war with a foreign power; and, where the property of individuals is taken, due compensation will be made in each case. 
Any person can purchase land in the Archipelago of Jolo and hold the same by obtaining the consent of the Sultan and coming to satisfactory agreement with the owner of the land, and such purchase shall immediately be registered in the proper office of the United States Government. 
Article V. All trade in domestic products of the Arrchipelago of Jolo, when carried on by the Sultan and his people with any part of the Philippine Islands, and when conducted under the American flag, shall be free, unlimited, and undutiable. 
Article VI. The Sultan of Jolo shall be allowed to communicate direct with the Governor-General of the Philippine Islands in making complaint against the Commanding Officer of Jolo or against any Naval Commander. 
Article VII. The introduction of firearms and war material is forbidden, except under specific authority of the Governor-General of the Philippine Islands. 
Article VIII. Piracy must be suppressed and the Sultan and his Datos agree to heartily cooperate with the United States authorities to that end, and to make every possible effort to arrest and bring to justice all persons engaged in piracy. 
Article IX. Where crimes and offenses are committed by Moros against Moros, the government of the Sultan will bring to trial and punishment the criminals and offenders, who will be delivered to the government of the Sultan by the United States authorities if in their possession. In all other cases persons charged with crimes or offenses will be delivered to the United States authorities for trial and punishment. 
Article X. Any slave in the Archipelago of Jolo shall have the right to purchase freedom by paying to the master the usual market value. 
Article XI. In case of any trouble with subjects of the Sultan, the American authorities in the islands will be instructed to make careful investigation before resorting to harsh measures, as in most cases serious trouble can thus be avoided. 
Article XII. At present, American or foreigners wishing to go into the country should state their wishes to the Moro authorities and ask for an escort, but it is hoped that this will become unnecessary as we know each other better. 
Article XIII. The United States will give full protection to the Sultan and his subjects in case any foreign nation should attempt to impose upon them. 
Article XIV. The United States will not sell the island of Jolo or any other island of the Jolo Archipelago to any foreign nation without the consent of the Sultan of Jolo. 
Article XV. LATEST PROPAGANDA FROM MALAYSIA DEPUTY INSPECTOR GENERAL OF THE POLICE March, 23, 2013 - 6:52 pm: "Sulu military commander captured; Kuala Lumpur security forces have successfully crippled the movements of the terrorists from Sulu" 

OUR VIEW: Do these Kuala Lumpur officials really believe that they've 'crippled' the Suluk Army movement with the arrest of one Suluk and his wife in Sabah? 

They must have been reading lots of fairy tales to cling to such fantasmagorical beliefs that they can cripple the Tausugs of Sulu just like that! Fantasmagorical declarations won't make a dent in the Suluk Army's great fighting prowess.

Tan Sri Khalid Abu Bakar merely is extending the stupidity of Kuala Lumpur officials when they propagate historical fantasies to their people whom they have been feeding during school years with some completely rubbish examples. 
Some of the lies that Kuala Lumpur officials deliberately propagate to Peninsular Malaysia youth which, if we do not put a stop to, will be historical fantasies that Sabahan youth will be believing: 

(1) that Malaya fought for its independence from the Brits which is total hogwash! The Malayans did not want to be independent -- they were so fearful of being left with the Chinese in Malaya, they wanted the Brits to stay and play nanny to them. But the Brits said, "You are going to have your independence whether you like it or not in 1957." 
(2) Kuala Lumpur officials continue to spread the fallacy that MALAYSIA gained their independence from the British in 1963 which is total hogwash. MALAYSIA was created in 1963 by "federating" Malaya Federation (Peninsular Malaysia whose capital today is Kuala Lumpur), Singapore, Sarawak and Sabah so how could the Brits grant MALAYSIA Independence when it was only created in September 1963. Furthermore, the Brits had technically and very officially not ruled Malaya Federation since 1957!  
(3) that Malayans were responsible for the defeat of communists in Peninsular Malaysia which is an utter, total hogwash. It was the Brits led by General Gerald Templar along with the Aussies, the Indian recruits and the Gurkhas who fought and defeated Communist insurgents in Malaya! The bone-idle Malayans could not be trusted to fight with the Brits. Half the time, local Malayan intel was rubbish... Oh, yes, the Malayans carried the bags and drove for the fighting soldiers of the combined British Commonwealth but doing the fighting? No way. In fact, a senior British military officer said the Malayan SOB recruits were "a total waste of precious meagre rations."
(4) that Malayans fought the Indonesians in what has been known as the Konfrontasi, the low-intensity armed conflict over Sarawak which took place 1962-1966; complete, utter hogwash! The Malayans did not do bloody anything! It was the Brits, the Aussies, the New Zealanders, the Gurkhas, the Indian recruits who fought the Indonesians during the Konfrontasi years! Where were the Malayans? Twisting their bone idle bodies, doing nothing, incapable of lifting their backsides even if it meant their very own survival!
(5) through a series of half-truths and printed tricks, that North Borneo (Sabah) was included in the Malaya Federation (Attn: Malaya Federation is not Malaysia Federation) which was given independence by the British in 1957. A complete fabrication which must be told Sabahans.

Kuala Lumpur spews lies, lies, lies, etc, etc., etc., ...The Malayans are the greatest propagandists of lies, much like their best friends today, China...

So, we say to Malaya's Deputy Director General of the Police Tan Sri Khalid Abu Bakar: Go tell what you say to your marines!

REPORT FROM SABAH:

LAHAD DATU: The security forces have successfully crippled the movements of the terrorists from Sulu who intruded into Lahad Datu after capturing their military commander in Semporna, early this morning. 
Deputy Inspector-General of Police Tan Sri Khalid Abu Bakar said the man, in his 40s, was detained with his wife at a swampy area at 1.30am after a tip off.
He said the security forces also detained a local who provided all the needs of the terrorists from the early days of their landing in Kampung Tanduo on Feb 12 until today. 
Without going into further details on the man who is in his 40s, Khalid said he was caught at 10pm yesterday in Kampung Tanduo and was now being held under the Immigration Act. 
“The local coordinator has been identified as the individual who made arrangements for food and drinks, accommodation, transportation and medicine for the terrorists since the early part of the intrusion. 
“With the capture of the commander and a local stooge of the terrorists, I am confident the terrorist group is now crippled,” he told a media conference at the security forces operations heaquarters at Felda Sahabat 16 near here today.
Khalid said with the capture of the two individuals, he believed the movements of the remnants of the terrorists were now limited and weakened as they were directionless and no longer getting assistance from locals.

Imperative to remember that Sultanate of Sabah and North Borneo has nine recognised royal heirs

ON SABAH PROPRIETARY RIGHTS (DIFFERENT FROM SOVEREIGNTY RIGHTS WHICH BELONG TO THE REPUBLIC): THE SULTANATE OF SULU HAS NINE LEGALLY RECOGNISED ROYAL HEIRS...

And their intra-family bickering must not affect whatever the Republic's position is on its claim to Sabah which, by law -- by virtue of Republic Act 5446, is Philippine territory. 

The nine royal heirs must be allowed to decide among thelselves who their sultan is... we, the non-sultanate member citizens of the Republic, must leave them alone to sort out their own family problem. 

Government must therefore abstain from putting more fat in the already confusing problem by remarking "We don't even know who the legitimate sultan is!" Government must step back and avoid such confusing remarks because the principle of Government support for their struggle must be for the Sultanate of Sulu as a body. 

Unless government and the public come to terms with the principle that there are nine legal heirs representing the Sultanate of Sulu, Government itself will be defeating the Republic's own legal cause.

Government must not cofuse the people of this country and instead must revert to the Philippine law and use it to Government's advantage in trying to resolve the Sabah crisis which has now claimed several dozens dead in the hands of a foreign government's maniacal troops.

A letter to President Aquino on the Kuala Lumpur sponsored circus trial of eight Filipinos


A letter to the President of the Philippines (in picture) 

Subject: The Kuala Lumpur sponsored soon-to-be circus trial (in picture right) of the eight Filipinos charged with terrorism, including two of them who were also charged with waging a war against the Yang di-Pertuan Agong (King of Malaysia).

Mr President, 

You virtually went on bended knees crawling before China authorities to spare the lives of some convicted drug mules on the pretext that every Filipino life is important.

But sadly, that personal doctrine of yours (or was that perhaps just for show?) went straight into the rubbish bin when it came to Sabah and to your friendship with Najib. You implied that your peace deal with the MILF which Kuala Lumpur has been engineering for you - but which was, in reality, a Malaysian strategical ploy for you to bury the Sabah claim - took premium over the lives of the peaceful Suluks who went to Sabah to stake their claim.

Instead of reassuring the Suluks, you disowned and publicly humiliated them on nationwide television, parroting the lines of Najib who literally was crapping all over you, over your manhood, over your dignity - AND THIS NATION's DIGNITY, even as Malaysians themselves were surprised that you had become Najib's spokesman.

Incidentally, Mr President, you may not know it - or may have chosen to ignore it, your friend and bogus "peace" engineer Najib Razak is the son of former Malaysia prime minister Tunku Abdul Razak who hated PH so much after your own Daddy (RIP) denounced Operation Merdeka back in the late 60s that he (Najib's Daddy) began funding the MNLF and MILF rebellion in the South.

Mr President, lest you forget, it was a foreign military with seven battalions of troops armed to the teeth who, upon orders of a foreign government (never mind if the leader of that foreign government was your best friend), launched the attack on the Filipino Tausugs in Tanduo and not the other way around as you and your brilliant advisers would like the public to believe.

Today, you stand accused in the court of public opinion of betrayal of trust, of violating your oath as president of the Republic, of de facto burying the nation's Sabah claim, of inaction in time of crisis, and even of cowardice, but Mr President, you can still redeem some of the remaining shreds of dignity this nation has left by fighting for our people who are facing the wrath of a foreign government and its armies that are occupying Sabah which, as you have now been told, is Philippine territory by PH law by virtue of Republic Act 5446.

If you choose to continue ignoring the plight and the human rights abuses heaped against our fellowmen in Sabah by a foreign government and its armed component, heaven help you Mr President but you will go down in history as the most ignoble and morally corrupt leader this country has ever known. But if you turn around now and show a brave face against the officials of Kuala Lumpur in defence of your people, you just might end up a hero in public eyes.

Think about it Mr President! It's never too late to show even a sliver of courage.

REPORT: The eight accused Filipinos were among 107 suspected Sulu gunmen or suspected local supporters of the Kirams who were arrested by Malaysian security forces in sweeps in the districts of Lahad Datu, Tawau, Kunak, Sandakan and Semporna.
Radio 24 confirmed that as in Wednesday’s arraignment, none of the accused entered any plea.

Radio 24 said Malaysian Attorney General Abdul Gani Patail led prosecution.

Like the Sabah-based radio station, Radio 24 said no lawyer assisted the accused during both proceedings.

Radio 24 reported the judge as ordering the attrorney general to determine whether defense lawyers will be “appointed by the Bar Council of Malaysia, the Philippine government or the accused themselves.”

Peninsular Malaya or Malaysians defeating Communists in Malaya is a total and baseless myth

SETTING THE RECORD STRAIGHT! TO THOSE WHO THINK THAT MALAYANS OR PENINSULAR MALAYSIA WIPED OUT COMMUNIST INSURGENCY IN PENINSULAR MALAYA, PLEASE DON'T BE MISLED -- THEY DID NO SUCH THING! 

You will be doing Filipinos great injustice if you think the Malayans or the Peninsular Malaysians had such fighting history. So please learn or read Malaysia/Malaya history. IT IS IMPERATVE TO KNOW YOUR ENEMY TO BE ABLE TO FIGHT THEM EFFECTIVELY

As one senior British military officer who served in Malaya during the Emergency said, "The Malayan recruits were for the most part bone-idle sons of bitches and could not be trusted; just a waste of precious meagre rations."

It was not Malayan troops or Kuala Lumpur troops that "exterminated communist insurgency" in Malaysia or Malaya Peninsula as one commenter would have it. It was the British and the Bitish Commonwealth of Nations (with Malayans playing the onlookers or carrying logsitics at best, the Brits could not even trust Malayan native intel/info half the time) led by General Gerald Templer together with the Aussies, the New Zealanders, the Indian recruits and of course, the dreaded Gurkhas who scared the livinng daylight out of the ordinary Malayans who thought the Gurkhas were devil incarnate...nothing to do with the bone-idle Malayan sons of bitches! British General Templer only left the Malaya Peninsula after he had wiped out the communist insurgency.

  General Templer (in picture) was the one that coined the famous phrase, "of winning hearts and minds." He basically cornered them, put barrages around the jungle and did not let them through unless they were willing to surrender. He then had leaflets thrown at them from the air and promised them a house, business and a community life if they went out of the jungle and stopped fighting Tunku Abdul Rahman's government. (General Templer turned more than one million Chinese into Malaya citizens if they turned in and built communities far from the jungles for returning Communist insurgents.)

Basically, General Templer starved them and continuously chased them, harrased them, wounded and killed many of them if they did not surrender. He organised meetings with the Chinese womenfolk and told them to put pressure on their husbands, their fathers, their brothers, their sons, etc., that the Communists would be wiped out if they did not come out and did not stop what they were doing.

In fact, if you need to credit Malayans for helping defeat Communist insurgency, you must credit the Chinese women of Malaya who, after a time, put pressure on their menfolk to give up and accept the offer of the British.

The Malayans or the Malaysians DID NOT HAVE ANYTHING TO DO WITH IT, they merely did the carrying of logistics for the British and Commonwealth Forces if they could make the Malayans work, otherwise, "bone idle Malayan SOBs" just did not do anything! The Gurkhas did most of the dirty job if you really want to know! Anything remotely susggesting that Malayan troops participated in the war operations against the Communists which Kuala Lumpur might be spreading today and about participating in defeating the Communists in Malaya Peninsula would BE A BIG FAT LIE!

Do not forget that that during the latter years of the Malayan Emergency, the Brits technically had already given the Malayans their independence but General Templer stayed on to wage the most successful anti-Communist guerilla campaign the world has ever known.

You cannot trust the Malayans to do that sort of thing... they did not have the courage or the brains nor even the willpower to be able to do that kind of operation. In fact, Communist insurgency and the increasing number of Chinese in the Peninsula were two of the reasons why the Malayans were worried about being independent but Britain, as early as 1947, said they would have their independence in 1957 whether they liked it or not. So, please don't be misled or if you have to post about it, be accurate -- read your history, read about General Templer and how he defeated Communist insurgency for the Malayans. DO NOT BELIEVE MALAYSIAN LIES.

If ever, Peninsular Malaysia's first ever fighting experience is happening today! The crackdown on Filipinos in Sabah and the continuing hunt for the Filipino Sulu fighters in Sabah is the VERY FIRST EVER fighting experience the Malayans or the Malaysians (Kuala Lumpur) will have for that matter and they needed 7 BATTALIONS or nearly 7,000 troops backed by heavy firepower TO MAKE IT HAPPEN YET THEY ARE NOT EVEN SUCCEEDING!

DO NOT BELIEVE THAT MALAYSIA HAS A BETTER FIGHTING HISTORY THAN THE PHILIPPINES, because you will be doing yourselves great injustice and will be spreading an atrocious lie.

Lahad Datu: Is there a solution?

KOTA KINABALU: This is a requested sequel to my previous article titled “To whom does Sabah belong?” which attracted a high number of responses and shares in cyber space and triggering a unique volume of debate among netizens.
In the current piece, I will unmask the mindset of most Malaysian commentators before imparting more of my findings about the Lahad Datu debacle.
Firstly: To the families of policemen who died in the line of duty, my condolences here are as heartfelt and deep as those of mine for the families of innocent citizens who died in police custody including those inside motor vehicles as a result of police shootings.
Secondly: To the families of deceased Tausug warriors who had to assert their right to sovereignty with their lives, my profoundest sympathy that it has to come to such a stage as a result of the failings of my government and possibly that of yours as well. I condemn my government for our casualties and I leave it to you to rebuke yours if yours so deserve it.
By and large, not all homo sapiens are born intelligent, and the high tendency of them ending up as nincompoops rests on how he or she is brought up at home and of course that also includes the way they are educated.
Many countries in the world control the thinking of their citizens; for example, I was reliably told only a few weeks ago that the National University of Singapore does not have the subject called “Jurisprudence” for their law students; if this is true, my personal opinion is that it must have been deliberately done to prevent them from becoming lawyers who can think better.
On the other hand, Malaysians are indoctrinated from a young age with politically convenient half-truths which are spiced up with fabricated history about events that are authored by so-called historians who were never there in the first place; such brainwashing was authorised by an irresponsible government with a vicious tenacity to keep the citizens daft and executed right from primary schools up to tertiary levels.
For instance, all Malaysians read from government authorised history books believing that Sabah and Sarawak are of the same status with the remaining 11 states in West Malaysia – they are wrong!
Tunku Abdul Rahman uttered the following historical statements:
“The granting of self-government too would enable Sabah to stand on its own feet as equal with Malaya, Sarawak and Singapore.” (Sabah Times, Jesselton, Aug 30, 1963.)
Serial racists
As a result of the miserable education system, many Malaysians grew up to become full-blown serial racists and religious bigots who not only think that they are superior to other people, but also are unable to respond out of the box because they were only taught “what to think” instead of “how to think” for themselves; and worst, many Malaysians are not even aware of their own pathetic predicament much like when a shrink asks a mental patient “are you mad?” and the lunatic will always answer in the negative.
Like an orphaned lamb which grew up with a pack of wolf pups, the former mistakenly thought that it is strong and formidable like the latter when it was actually physically and psychologically compromised; such is my description of the general Malaysian public today.
It is not entirely the fault of Malaysians when many of them cannot understand basic, decent, and logical elucidation because the education system that churned them out is wanting; but if they continue to elect a bunch of clowns that is corrupted to the core to run the government which only knows how to fiddle with propaganda and figures to look good, the worst will get even worse.
While Malaysians per se are somewhat reasonable, many could not accept fact and truth particularly when they think their interests are in jeopardy; in short, they are unable to behave impartial.
For introducing the naked truth about the sovereignty of the Philippines over Sabah, a layman wrote that there is a difference between stealing something movable and stealing land – how much more preposterous can Malaysians be?
Netizens can find all the ridiculous arguments by Malaysians in the comments section of my immediate previous article in FMT; while not all Malaysians are warped in their thinking, I am sad to say more than 90% of the Malaysian comments therein are such.
Now back to the Lahad Datu skirmishes.
I still maintain that the whole episode is a sandiwara with pre-planned collateral damages thrown in. Is Najib Tun Razak planning to declare emergency, suspend the Federal Constitution, and impose martial law to delay elections which the Barisan Nasional will lose? Will this incident make the BN look more like a hero when our troops finally sweep in?
With the large number of soldiers from Peninsular Malaysia being deployed to Sabah at this time, how many tens of thousands more additional postal votes are we talking about now to bolster the chances of the BN in Sabah? What about the feelings of the 900,000 Tausug people in Sabah, how will it affect their votes?
Alternatively, has the parade now got out of control with the Sulu warriors no longer following the script?
Ridiculous suggestion
It was recorded that the Tausug people of Sulu were never colonised by any foreign powers; their warriors are war-hardened and fear nothing. A few decades ago, they were funded by Libya to fight the government of the Philippines. Was our government the one that trained, armed, and gave them safe haven? Was the same also true of the Acheh rebels in Indonesia and the Pattani separatists in Thailand?
I am unable to gauge the capabilities of our present troops to dislodge the so-called intruders, but I do worry for them and the civilians; the Tausug people never surrender and they never forgive. If their warriors are here to die fighting, they will be dead sure that many of our soldiers and civilians will follow them.
Let me now assume for a moment that the whole thing is not a conspiracy and the Malaysian government does not know how to solve it peacefully and diplomatically; should it not resign en bloc and let the people choose a new government to deal with it? The BN government does not have the authority from the rakyat to risk the lives of our troops, innocent civilians, and foreigners included.
There is another ridiculous suggestion a few days ago: when the nation was peaceful, non-Malays were side-lined or capped with a glass ceiling for promotion and rank in the police and armed forces; all of a sudden in war, Kadir Jasin said that non-Malays should now die for the country…! What kind of logic is that…?
If the Lahad Datu fiasco is real by any imagination, the federation has failed us disastrously; our comfort was all along artificial and looking back, the discredited formation of Malaysia in 1963 is now ludicrously confirmed as not only hugely insignificant but a complete flop and fatally flawed.
Malaya is enslaving Sabah and its politicians, who are not troubled by conscience, are subjugating us with foreign nationals by issuing citizenships to them and plundering our rich natural resources.
Our presence as the poorest of the poor in Malaysia is a clear indication that Sabah’s economy is not only on the retreat, but heading for world-record collapse at a speed few of us can comprehend. Malaya’s ambition is boundless; it seizes every opportunity meant for Sabah and what did our impoverished people get – terror in the end.
Just look at our infrastructure: a few new roads, a few magnificent government buildings, expensive homes for the elite; but our people are still as poor as ever on a colossal scale working day and night for a pittance. Compared with colonialism, this is much more oppressive and widespread than anything our former British colonial government was ever accused of.
Why must our government run on bribery and by notoriously corrupt pariah politicians while the police force on brutality? There is a real sense of anxiety among a lot of Sabah people that citizens do not have any real protection that we should have; fundamentally, we are now under siege, not only from Sulu gunmen but from Malaya. Why can we not have our own final say on our rights? Why must the people of Malaya insist on how we should live our lives? We are not a colony of anyone!
The people of Sabah are astonishing human beings with a limitless capacity for self-sacrifice; but today, I say: enough is enough. All Malaya politicians are hypocritical and disgraceful – well below the standards expected of decent leaders; the greatest justice for Sabah will triumph on the historic day all the Malaya-based political parties and their local running dogs are humiliatingly voted out by bold Sabahans in the 13th general election, effectively ending their dangerous and hate-driven abusive meddling in the affairs of Sabah, making us physically and financially ill.
Is there a solution?
A senior lawyer from Sandakan asked me about the Malaysia versus Indonesia case of Sipadan and Ligitan islands in which the International Court of Justice ruled that Sabah has sovereignty over the contested islands by virtue of an old legislation regulating the collection of turtle eggs ordained by the former British colonial government.
The Philippines applied to intervene as a third party in the proceedings but was disallowed because both Malaysia and Indonesia objected to it; now why? I believe both Malaysia and Indonesia will go home empty-handed because the Philippines can and will be able to establish sovereignty claims on Sabah thereby making ownership of the two islands theirs as well.
I asked him back: if in a court case, both sides of the legal team deliberately conceal evidence with the intention of misleading the judges, how legitimate is a judgment which was rendered in ignorance? His answer was “the judgment does not hold water”.
I was also asked about the Madrid Protocol signed by Germany, Britain, and Spain which contained provisions greatly distorted by lay Malaysian commentators.
If a bandit attempted to rob your house and then entered into an agreement with a second bandit in relation to the loots which may not have been taken from your house, is the agreement legal? The answer is NO because such agreement is void ab initio (from the beginning).
Readers who still think that just because certain people in Sabah of the past had chosen to form Malaysia on Sept 16, 1963, such action supersedes the sovereignty of the Philippines have complete absurd mentality. They should read what Tunku Abdul Rahman signed on July 31,1963 – Article 12 of the Manila Accord:
“The Philippines made it clear that its position on the inclusion of North Borneo in the Federation of Malaysia is subject to the final outcome of the Philippine claim to North Borneo. The Ministers took note of the Philippine claim and the right of the Philippines to continue to pursue it in accordance with international law and the principle of the pacific settlement of disputes. They agreed that the inclusion of North Borneo in the Federation of Malaysia would not prejudice either the claim or any right thereunder. Moreover, in the context of their close association, the three countries agreed to exert their best endeavours to bring the claim to a just and expeditious solution by peaceful means, such as negotiation, conciliation, arbitration, or judicial settlement as well as other peaceful means of the parties’ own choice, in conformity with the Charter of the United Nations and the Bandung Declaration.”
He also signed on Aug 5, 1963 – Article 8 of the Joint Statement by the Philippines, the Federation of Malaya, and Indonesia:
“In accordance with paragraph 12 of the Manila Accord, the three Heads of Government decided to request the British Government to agree to seek a just and expeditious solution to the dispute between the British Government and the Philippine Government concerning Sabah (North Borneo) by means of negotiation, conciliation and arbitration, judicial settlement, or other peaceful means of the parties’ own choice in conformity with the Charter of the United Nations. The three Heads of Government take cognizance of the position regarding the Philippine claim to Sabah (North Borneo) after the establishment of the Federation of Malaysia as provided under paragraph 12 of the Manila Accord, that is, that the inclusion of Sabah (North Borneo) in the Federation of Malaysia does not prejudice either the claim or any right thereunder.”
Ball in our court
From the above two provisions, any lawyer worth his seasoning will tell you that the inclusion of Sabah into the formation of Malaysia is subject to the claims of the Philippines. It is therefore also crystal clear as the morning sun that the British government screwed us up blue and purple with Malaya as the accomplice.
Before I forget, former president Ferdinand Marcos did not have the authority to renounce the Philippines’ claim over Sabah as issues concerning sovereignty must be approved by both houses of their Congress.
My previous article actually spelt out in clear and unambiguous terms what to expect in the whole scenario; but how many people really understood the implications and in between the lines, the remedy?
A chief editor of a popular online news portal asked me whether there is any immediate solution to end the impasse without incurring any further casualty on both sides. My answer was a definite YES and the ball is in our court.
Before I conclude this piece, my personal view about the Sulu warriors: if this incursion is not sandiwara, how come they did not take out the communication towers and lay siege on the airport and town?
If this invasion is real, our troops and civilians are going to suffer; everything the Tausug warriors did had the hallmarks of the strategies mapped out in Sun Tzu’s “Art of War” and I suspect they also have the standard operating procedure manual of Osama Laden’s Al-Qaeda.
By bringing the battles right to the heart of our towns (Lahad Datu, Semporna, and God knows how many more), they have nothing to lose; but not us, our terrified civilians will become refugees and our developments devastated. Try finding out how many percent of our troops including the top brass actually have war experience and you will know what I mean. The Tausug warriors have declared that they are not going back and will die here; if this does not send shivers down your spine, you really need to see a neurosurgeon…
For every casualty on either side, the BN government is to be blamed and held responsible; one word best describes the whole affair: “Kiaguk”…!
(“Kiaguk” is the Suluk word for stupid used by the Tausug people.)
